Terms & Conditions
Last updated: October 22, 2026
1. Who we are
Inkwell is an online drawing studio operated by Haedyn mullen ("we", "us", the "Seller"). When you use Inkwell or buy a Premium subscription, you are contracting with Haedyn mullen.
By creating an account, browsing the gallery, or otherwise continuing to use Inkwell, you agree to these Terms & Conditions. If you do not agree, please do not use the service.
2. The service
Inkwell lets you draw on a layered canvas with many brushes, create and share custom brushes, upload artwork to a public or private gallery, follow other artists, join communities, and receive AI-generated feedback on your art. A paid Premium subscription unlocks extra features such as unlimited custom brushes, the full brush library, and background photos.
We grant you a limited, non-exclusive, non-transferable right to use Inkwell within the plan you have selected (free or Premium). We do not guarantee that the service will be uninterrupted or error-free, and features may change over time.
3. Your account
You must provide accurate information when signing up and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. You must be of legal age in your jurisdiction, or have a parent or guardian's permission, to use Inkwell.
4. Acceptable use
You must not misuse Inkwell. That includes, but is not limited to:
- Using the service for anything unlawful, fraudulent, or spam-related.
- Uploading content that infringes someone else's intellectual property or rights.
- Uploading hateful, harassing, or sexually exploitative content, or content depicting minors inappropriately.
- Interfering with the security of the service — introducing malware, probing or scanning systems, or scraping the service or other users' data.
- Reverse engineering the service, reselling or redistributing it, or circumventing technical limits (such as the free-plan brush limits).
- Using automated means (bots) to create accounts or interact with the service.
5. Your content and intellectual property
You keep ownership of the artwork, brushes, comments, and other content you create on Inkwell. You grant us a limited license to host, store, process, and — for artwork you mark as public — display that content, solely so we can operate and provide the service.
You are responsible for the content you upload and must have the rights to anything you submit. If a rights holder believes content on Inkwell infringes their rights, they can contact us and we will review and, where appropriate, remove the content. Repeated infringement may lead to account suspension or termination.
Inkwell itself — the software, brush engine, documentation, and branding — remains the property of Haedyn mullen. These terms do not transfer any of that intellectual property to you.
6. AI feedback
Inkwell offers optional AI-generated feedback on artwork you choose to submit for critique. You are responsible for the images you submit and for how you use the feedback. AI feedback may be inaccurate or incomplete and is provided as creative guidance only — it is not professional advice of any kind. We may filter submissions or refuse to generate feedback for content that violates these terms.
7. Payments and subscriptions
Premium is a paid subscription billed weekly. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. You can cancel your subscription at any time; access continues until the end of the paid period. See our Refund Policy for refund details.
8. Suspension and termination
We may suspend or terminate your access to Inkwell if you materially breach these terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate our policies. When access ends, your public content may be removed and your account data may be deleted after a reasonable period.
9. Disclaimers and liability
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Our aggregate liability to you is capped at the fees you paid us in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.
10. General
We may update these terms from time to time; continued use of Inkwell after a change means you accept the updated terms. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays or failures caused by events beyond our reasonable control. These terms are governed by the laws of the Seller's jurisdiction, and disputes will be resolved in the courts of that jurisdiction.
